1. Acceptance of Terms
By accessing or using the evtOS platform at evtos.io (the "Platform"), including any mobile applications, APIs, or embedded widgets, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and evtOS ("we", "us", or "our").
Age requirement: The Platform is restricted to individuals aged 18 years or older. By registering an account, purchasing a ticket, or otherwise using the Platform in any capacity, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. evtOS does not independently verify user age, and disclaims all liability for any harm, loss, or legal consequence arising from a user's misrepresentation of their age.
2. Description of Service
evtOS is a modular event management platform providing infrastructure for event organisers and their attendees. The Platform includes, but is not limited to:
- Ticketing and registration management
- Payment processing via Paystack
- Food and beverage ordering systems
- Exhibition and lead capture tools
- Cashless wristband and NFC payment integration
- Programme and schedule management
- Communications and push notification tools
- Analytics and settlement reporting
- White-label and embed SDK capabilities
evtOS provides the technology infrastructure only. We are not the organiser, promoter, or host of any event listed on the Platform.
3. User Accounts
Organiser accounts: Organisers are responsible for the accuracy of all event information they publish, including dates, venue, ticket pricing, and event descriptions. Organisers are solely responsible for delivering the events they create and for complying with all applicable laws and regulations in the jurisdiction where the event takes place.
Attendee accounts: Attendees are responsible for the security of their account credentials. Ticket purchases are subject to the Ticketing Terms & Conditions. Attendees must comply with the rules and entry requirements set by the event organiser.
You agree not to share your account credentials, create accounts on behalf of others without authorisation, or use the Platform under a false identity.
4. Acceptable Use
You agree not to use the Platform to:
- Publish false, misleading, or fraudulent event listings
- Engage in ticket touting, scalping, or unauthorised resale
- Circumvent or tamper with payment systems or QR code validation
- Upload malicious code or attempt to disrupt Platform services
- Collect personal data from other users without their consent
- Violate any applicable law, including Kenyan consumer protection, data protection, or financial regulations
We reserve the right to suspend or terminate accounts that violate these provisions without notice.
5. Intellectual Property
The evtOS name, logo, Platform design, and underlying software are the intellectual property of evtOS and are protected under applicable laws. You may not copy, reproduce, modify, or distribute any part of the Platform without our prior written consent.
Event organisers retain ownership of their own content (event descriptions, images, branding) but grant evtOS a non-exclusive, royalty-free licence to display that content on the Platform for the purpose of operating the service.
6. Platform Availability and Modifications
Platform availability: evtOS is a live platform under active development. Features may be added, modified, or improved over time. We do not guarantee uninterrupted availability and will endeavour to provide advance notice of significant changes or planned maintenance. During periods of high development activity, features may change without prior notice.
We shall not be liable for any loss arising from Platform downtime or feature changes.
7. Limitation of Liability
To the maximum extent permitted by Kenyan law, evtOS shall not be liable for:
- Any indirect, incidental, consequential, or punitive damages arising from your use of the Platform
- The conduct or actions of event organisers or attendees
- Event cancellations, postponements, or failures to deliver by the organiser
- Payment processing failures or delays caused by Paystack or other third-party services
- Loss of data, revenue, or business opportunities
Our total liability for any claim arising under these Terms shall not exceed the fees paid by you to evtOS in the three months preceding the claim.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
9. Changes to Terms
We reserve the right to update these Terms at any time. We will notify users of material changes by email or by displaying a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
We recommend reviewing these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were last revised.
10. Platform Fees and Commission
By registering as an organiser on evtOS, you agree to the following fee structure:
- Free events: no commission charged to organisers, ever.
- Paid events: 3.5% of the face value of each paid ticket, applied from the organiser's fourth event onwards. Commission is calculated on the post-discount price when a promo code is applied.
- Events 1–3: no ticket commission regardless of ticket price, for all organisers.
- Founding organisers: zero ticket commission on all events, permanently. Founding status is granted by evtOS at its discretion and cannot be transferred.
- NGO/Charity organisers: zero ticket commission on all events, granted upon verification of NGO/charity registration status by evtOS at its discretion.
- Vendors: no fees of any kind. evtOS charges vendors nothing for using the platform.
- Exhibition platform fee: applies to trade exhibitions and expos only. Rate is confirmed at event setup.
- Exhibition intelligence tiers: Basic (included), Pro (KES 5,000–8,000 per booth), Premium (KES 10,000–15,000 per booth).
- White-label licence: monthly fee scaled by active user count. Rate agreed at contract.
Settlement: payouts are processed after each event closes and settlement is approved by the organiser. Settlements are disbursed net of applicable commissions. You must have valid payout details configured to receive settlement.
All fees are subject to review and may be updated with 30 days' notice. Your continued use of the Platform after such notice constitutes acceptance of the revised fee schedule.
11. Data Handling and Privacy
evtOS is operated by AdGo Solutions Limited, a company registered in Kenya. AdGo Solutions Limited is a registered data controller with the Office of the Data Protection Commissioner (ODPC) of Kenya.
We collect and process personal data in accordance with the Kenya Data Protection Act, 2019, and our Privacy Policy. By using the Platform, you consent to the collection, processing, and storage of your personal data as described therein.
Attendee data collected through your events (names, email addresses, purchase history) is processed on your behalf. As an organiser, you are responsible for ensuring your use of attendee data complies with applicable data protection law.
Data subject rights under the Kenya Data Protection Act — including the right to access, correction, and erasure — can be exercised by contacting us at hello@evtos.io.
